بازرگان یا تاجر به فردی اطلاق می‌گردد، که شغل خود را معاملات تجاری قرار می‌دهد و به دلیل آنکه معاملات تجارتی، خرید و فروش به قصد انتفاع است، بنابراین کلیه اشخاصی که مبادرت به خرید و فروش یا اجاره اموال منقول می‌نمایند، تاجر شناخته می‌شوند. از آنجا که طبق ماده ۵۸۸ قانون تجارت اشخاص حقوقی نیز می‌توانند دارای حقوق و مسئولیت‌هایی که قانون برای افراد وضع کرده باشند، بنابراین شرکت‌های تجارتی هم تاجر تلقی می‌شوند.[۱]


با این ترتیب ظاهراً کسبه نیز در ردیف تجار قرار داده شده‌اند و این معنی از شق ۱ ماده ۲ قانون بر می‌آید بنابراین کسبه جزء نیز از مزایای قوانین تجارتی بی بهره نیستند. منتهی در تشریفاتی که به جهت انتظام امور تجارت وضع شده کسبه جزء مستثنی گردیده‌است. مثلاً این دسته از داشتن دفاتر تجارتی و ثبت تجارتخانه معاف اند و در موقعی که از اداء دیون خود عاجز باشند، تابع مقررات ورشکستگی نیستند.


تشخیص اینکه چه کسی کاسب جزء می‌باشد چون در هر زمان فرق می‌کرده و تعریف جامع و مانع آن در قانون اشکال فراوان داشته، به نظر وزارت دادگستری موکول شده که طی آئین‌نامه معلوم شود.


با تمام این احوال قانون، معاملات تجارتی را معلوم نموده و آن را به ده قسمت تقسیم کرده، بنابراین کسی که شغل خود را یکی از اقسام ده‌گانه قرار دهد از نظر قانون تاجر شناخته می‌شود.
